Brand abuse affects more than just the strength of trademark rights; it affects customers’ safety, a company’s reputation and ultimately, the corporate bottom line. In fact, according to a recent Gartner study1 , an estimated 57 million American adults received e-mail attacks from “phishers” posing as well-known companies. Unfortunately, approximately 1.78 million of those receiving e-mail attacks disclosed sensitive financial and personal information, which may result in their identity being used in future acts of fraud. Additionally, Gartner found that U.S. banks and credit card issuers suffered 1.2 billion in direct losses as a result of these e-mail “phishing” attacks. With so much at stake it is critical to have a plan in place to respond to the many varieties of online brand abuse. Attendees of “Somebody’s Using My Brand on the Web! Now What?” will learn about the different forms of brand abuse, such as cybersmearing, cybersquatting, counterfeiting, grey-market distribution, bad association, metatag abuse, and phishing, and how they can respond quickly and effectively to combat the abuse of their brand online. They’ll return to their companies armed with information including, current case law, a checklist of potential courses of action, the pros and cons of each, and sample documents to use throughout use throughout the process.
